Open Question: DHL lost my phone that i ordered on AT&T's website. Will i get my money back? send me another phone?

So i bought a phone (the quickfire) online with cingular/AT&T. It was suppose to be a 2 day shippment with DHL. But its been almost 2 weeks. I kept asking DHL about it, but they said it would be shipped 11/17. So i checked the tracking at DHL's website...and it said my phone was in Oakland,ca, about 20 minutes from my house. And its almost 5 days late. And now theyre saying they cant find it and told me to make a loss claim to AT&T. Shouln't it be to DHL? I mean the last time it was tracked it was with them...not cingular... idk... But has that happened to anyone? How does the whole process work? Will they give me a full money refun?
